1. Agreement
These Terms of Service govern your use of FreightFiles. By creating an account, starting a trial, purchasing a subscription, or otherwise using FreightFiles, you agree to these Terms.
2. FreightFiles service
FreightFiles provides software for transportation and trucking operations, including tools for trips, equipment, drivers, documents, invoices, brokers, dispatch operations, tracking, and related business workflows.
FreightFiles is a software platform and is not a freight carrier, broker, insurer, legal advisor, accountant, or transportation regulator.
3. Accounts
You are responsible for maintaining accurate account information, protecting login credentials, and ensuring that only authorized users access your company workspace.
You are responsible for the activity performed through your account and by users you authorize.
4. Free trials
Eligible customers may receive a 14-day free trial. A valid payment method may be required when starting the trial.
Unless cancelled before the end of the trial, the selected subscription will automatically begin and the applicable subscription fee will be charged.
5. Subscription billing
FreightFiles subscriptions are billed on a recurring basis according to the plan selected at checkout.
Subscription payments are processed by Stripe. You authorize Stripe and FreightFiles to charge the payment method associated with your subscription for recurring fees and applicable taxes or charges.
6. Plan limits
Subscription plans may include limits on trucks, trailers, drivers, users, storage, or other functionality. You may need to upgrade your subscription to exceed the limits of your current plan.
7. Cancellation
You may manage or cancel your subscription through the available billing portal. Cancellation generally prevents future recurring charges but does not automatically entitle you to a refund for amounts already paid.
8. Refunds
Except where required by law or expressly stated otherwise, subscription fees are non-refundable once charged. FreightFiles may choose to provide refunds or credits at its discretion.
9. Customer data
Your company retains ownership of the business information and files it uploads to FreightFiles. You grant FreightFiles the limited rights necessary to host, process, transmit, display, and back up that data for the purpose of providing the service.
You are responsible for ensuring you have the right to upload and process information entered into FreightFiles.
10. Acceptable use
You may not use FreightFiles for unlawful activity, unauthorized access, malware distribution, fraud, abuse, interference with the service, or infringement of another person's rights.
11. Availability
We work to keep FreightFiles available and reliable, but we do not guarantee uninterrupted or error-free operation. Maintenance, outages, third-party failures, security incidents, or other circumstances may temporarily affect service availability.
12. Limitation of liability
To the maximum extent permitted by applicable law, FreightFiles will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business opportunities, or loss of data arising from use of the service.
13. Changes to FreightFiles or these Terms
We may modify FreightFiles, subscription features, pricing, or these Terms from time to time. Material changes will be reflected in an updated version of these Terms or otherwise communicated where appropriate.
